TERMS AND CONDITIONS:
The following purchase policies and Rules and Regulations shall be the agreement between you and us regarding your use and/or purchases at Arlingtoncowboysparking.com and your subsequent use of our facility. If you have any questions about the information about these policies and Rules and Regulations, please contact us. By clicking “Buy Now” button, by clicking “BOOK NOW” or any similar purchase button, or by using our facility, you have agreed to all of the following terms and conditions, rules and regulations.
We make every effort possible to process parking pass orders as soon as we receive them, in most cases within twenty-fours hours, some orders may take longer to fulfill. If you order parking passes on same day of event, we cannot guarantee your order.
We accepts payments through Paypal. We also accept cash, cashier's checks, money orders, credit card (subject to additional convenience fee) and payment through ParkWhiz. We reserve the right to ask for further documentation such as credit card authorization, copy of picture ID, imprint of original credit card used for transaction, and/or any other document to establish purchase and/or ID of purchaser.
NO REFUNDS OR EXCHANGES/ ALL SALES ARE FINAL:
Before purchasing parking pass(es), carefully review your event selection. Once we receive your order we are unable to refund, cancel, or exchange pass(es). When you pick up pass(es) from our offices, please keep pass(es) in a safe place, we cannot issue exchanges or refunds for lost, stolen, damaged, or destroyed pass(es).
If an event is cancelled or postponed, and you are unable to attend the new date, then we will issue a complete refund, if applicable. Any shipping charges, handling charges, and fees charged and collected by Paypal to us are not refundable. Certain restrictions do apply, please contact us regarding your event.
HOLD FOR PICKUP:
No parking pass will be mailed or emailed. All parking pass(es) are held for pick up on date of event at Days Inn 910 N. Collins, Arlington, TX 76011 with proof of payment. Any parking pass(es) not picked up by the official start time of event are deemed used and not refundable. Person picking up the parking pass must be same person who purchased parking pass.
DO NOT PARK AND LEAVE WITHOUT PARKING PASS SHOWING ON DASHBOARD:
Vehicle without a validated parking pass will be towed at vehicle’s owner’s sole costs and expenses. Always check-in with parking attendant, show your ID, and get your parking pass issued and validated by parking attendant.
We reserve the right to cancel any parking pass purchases for any reason, including but not limited to incorrect billing information, fraudulent purchasing, and/or failure to provided any additional document requested by us.
USE, RESALE, AND OWNERSHIP OF TICKETS:
Parking pass purchased through Days Inn or Randol Asset Management: 1) is for individual use only, not for resale, and shall not be used for any commercial, advertizing, or marketing purposes; 2)remains the property of Randol Asset Management and is non-refundable, non transferrable and not for resale. Resale will automatically void parking pass, barring refunds, exchanges, and use.
SALES AND USE TAX:
Unless otherwise specified or collected in the purchase, sales and use tax is included in the total cost of parking or tailgating pass. Part of your parking or tailgating pass cost pays for sales and use tax.
All parking pass prices are in US Currency. Parking pass prices and availability are subject to change at any time. We will not be responsible for any weather delays, event postponements, event cancellations, lost, or stolen passes. We reserve the right to refuse service and/or to ask customer to leave our parking lot at any time for any reason. Back of lot parking space may be obstructed. Back of lot parking space is not suitable if you need to leave early or if you are unwilling to wait at the end of the event. Parking pass does not guarantee parking space in case of limited capacity. Parking space is on first come first serve basis.
We are an independent, privately-owned company engaged in the service of providing parking pass(es) to the lot that is between lot 10 and 15 of Cowboys Stadium. We are not affiliated with, or authorized by, nor do we have any licenses or strategic alliances with any box office, promoter, venue, theater, stadium, sporting team, or sporting association.
LIABILITIES AND HOLD HARMLESS AGREEMENT:
The Parking Pass licenses you to park one car in a designated area at your sole risk and at posted rates for maximum one day. Any car parked at this facility is parked at the car owner’s sole risk. OPERATOR does not guard or assume care, custody or control of your vehicle or its contents and is not responsible nor liable for fire, theft, damage or loss or inability to move vehicle or leave lot due to double parking or for any other reasons. The car owner alone is responsible for parking and locking his car. OPERATOR issues Parking Pass as your contract, subject to the terms and conditions as contained herein, and for timekeeping purposes only. Only a license to park is granted by Parking Pass and no bailment is created. Parking Pass is not a claim check. You authorize us to move your car to other section of facility without being liable for any damage even if caused by the acts and/or our negligence and/or neglicence of our agents or employees. You agree to indemnify Operator, owner, and their agents of this facility against all loss, damages, claims, legal fees and court costs resulting from your parking of a car at this facility or your purchase of a parking pass from us. You further agree that if we employ an attorney to present, enforce or defend the terms of this agreement or our rights hereunder, you will pay our attorney’s fees and expenses incurred by us in such connection. No employee may modify or waive any of the terms of your contract. OPERATOR reserves the right to move your car, without incurring any liability and/or being responsible for any damage, at any time to other part of the facility, with or without notice to you. By parking your car at this facility, you have accepted and agreed to all terms contained herein.
GOVERNING LAW AND VENUE:
The laws of the State of Texas shall govern the interpretation, validity, performance and enforcement of this agreement. If any provision of this agreement should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions of this agreement shall not be affected thereby and it shall be construed that such invalid or unenforceable provision had never been contained herein and the remaining provisions of this agreement shall be enforced. Venue for any action under this agreement shall be Tarrant County, Texas.
RULES AND REGULATIONS:
All guests wishing to park at our facility located at 910-934 N. Collins, Arlington, Texas must observe the following Rules and Regulations. By being at our facility, you shall be deemed to have read, accepted and agreed to all terms, conditions, Rules and Regulations contained herein. These Rules and Regulations have been developed to provide a fair, reasonable and safe parking experience for guests. Failure to follow these Rules and Regulations may result in the loss of parking privileges and/or license and ejection from the parking lot. Failure to enforce any Rules and Regulations shall not be deemed a waiver.
DIRECTIONS AND INSTRUCTIONS:
All guests must follow the directions and instructions provided by parking attendant (parking staff, security, police, government officials, etc.)
Parking Spots are for Vehicles Only:
Parking spots are for standard size vehicles only. Drive aisles must remain clear at all times. No items (coolers, tents, tables, chairs, etc.) of any kind may be placed on the ground behind, in front of or around parked vehicles.
MULTIPLE PARKING SPACES:
Do not park in double or multiple parking spaces in the event you plan to leave early or earlier than end of special event. In the event you park in this type of parking area and you are blocked off, you will be responsible to wait for driver of other vehicle to move their vehicle. When parking in double or multiple parking spaces, you agree to move your vehicle immediately at the conclusion of the special event so as to allow other people parked in same area to leave.
Tailgating is permitted in designated tailgating spaces only. Tailgating spaces are available on a first come/first served basis. Guests parked in a designated tailgating space must restrict their use of the sidewalk or space to the space behind their vehicle. You may not spread out and use the sidewalk or space area behind other tailgating parking spaces. Do not leave anything (tent, table, etc.) unattended or not secured in the parking and/or tailgating area while attending Event.
All guests wishing to tailgate must observe the following guidelines. These guidelines have been developed to provide a fair, reasonable and safe tailgating experience for guests. Failure to follow these guidelines may result in the loss of tailgating privileges and ejection from the parking lot.
· Tailgating spaces are for vehicles only. Each vehicle must have a valid parking permit.
· Tailgating is defined as the placement of any item on the ground (chairs, coolers, grills, games, etc.).
· Tailgating is only permitted in the sidewalk areas on the North perimeter of the parking lot.
· Tailgating is permitted from the time that lots open and up to two (2) hours following Dallas Cowboys or college football games.
· All guests must follow the directions and instructions provided by parking attendant (parking staff, security, police, etc.).
· Purchaser shall be responsible to inform and obtain agreement from all its guests or invitees about the herein Rules and Regulations prior to them arriving on premises and Purchaser shall be responsible to make sure that all its guest and invitees follows the Rules and Regulations.
· Dispose of trash in the appropriate receptacles.
PROHIBITED ITEMS/ ACTIVITIES:
The following items/activities are prohibited at our facility:
o Deep fryers or any oil-based cooking or frying
o Charcoal cooking.
o Open flame fires of any kind. Gas cooking is permitted.
o Disorderly conduct
o Picketing, political campaigning or soliciting/distribution of any kind
o Saving parking or tailgating spaces
o Weapons and fireworks
o Sale of food, beverage, merchandise, etc.
o Advertising or displaying any sexually oriented business
o Amplified sound systems or the use of radios/audio devices at loud levels
o Ticket scalping
o Abusive, foul or disruptive language
o Throwing objects
o Blocking fire lane or parking circulation aisles
o Creating fire hazard
o Trespassing, soliciting, peddling and loitering
o Any other item or action deemed dangerous or inappropriate
CODE OF CONDUCT:
We are committed to creating a safe, comfortable and enjoyable experience for our guests. Our staff will proactively support an environment free from the following behaviors:
· Abusive, foul or disruptive language and obscene gestures
· Intoxication or other signs of impairment related to alcohol consumption
· Fighting, taunting or threatening remarks or gestures
· Sitting in a location other than the guests ticketed seat
· Displays of affection not appropriate in a public setting
· Obscene or indecent clothing
Continuing inappropriate behavior may result in the guest being ejected, arrested by police, or having his/her parking pass revoked without refund.
